Lost and Found Crew — Terms and Conditions

1. Eligibility

  • You must be at least 18 years old to use the Lost and Found Crew app and services.
  • By using the app, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

2. Real-Time Location Tracking

  • We collect your real-time GPS location to provide features like proximity to other users and public meetup points (“hangouts”).
  • Location data is collected only when you enable location services and while the app is active.
  • By enabling location tracking, you consent to this collection and understand the risks of sharing live location data.
  • You can disable location tracking at any time via the app or device settings, but this may limit functionality.
  • We do not sell or share your location data with third parties except as detailed in our Privacy Policy.
  • We disclaim liability for any harm resulting from misuse of your location data by other users.

3. User Content and License

  • You are solely responsible for all content you submit, including photos, descriptions, messages, and other data. Content must not be unlawful, defamatory, infringing, or harmful.
  • By submitting content, you grant Lost and Found Crew a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, adapt, publish, and display your content:
    • Within the app and website.
    • For marketing, promotional campaigns, social media, and public relations.
    • In case studies or testimonials.
  • We will not use your content in a misleading or defamatory manner and will anonymize it where possible unless you provide express permission for attribution.
  • To opt out of promotional use of your content, email [email protected]. We will process requests promptly.
  • We reserve the right to remove or moderate content that violates these Terms or is otherwise inappropriate.

4. Yachtie Verification and CV Submission

  • Users applying for yachtie verification must submit their CV and relevant personal information for review.
  • By submitting your CV, you consent to Lost and Found Crew processing this information solely for the purpose of verifying your yachtie status.
  • We do not share your CV or personal employment details with third parties except as necessary for verification or as required by law.
  • Your CV data is retained only as long as necessary for verification and related purposes.
  • You may request deletion or withdrawal of your CV data by emailing [email protected].
  • Submission of false or misleading information may result in account suspension or termination.

5. User Obligations and Conduct

  • You agree to use the app in compliance with all applicable laws and regulations.
  • You will not:
    • Harass, threaten, abuse, or harm other users or third parties.
    • Post content that is unlawful, fraudulent, offensive, obscene, or infringes on intellectual property rights.
    • Use the app for fraudulent or malicious activities.
    • Attempt to interfere with or disrupt the app or servers.
  • We reserve the right to suspend or terminate accounts that violate these rules.

6. Disputes Between Users

  • Lost and Found Crew acts as a platform connecting users but does not verify ownership of lost or found items beyond yachtie status verification.
  • We are not responsible for any disputes, damages, or losses arising from user interactions or transactions.
  • Users are encouraged to meet in safe, public locations and verify ownership offline.

7. Privacy and Data Protection

  • We comply with applicable data protection laws including GDPR, CCPA, and others.
  • Users have rights to access, correct, delete, and restrict processing of their personal data as described in our Privacy Policy.

8. Cookies and Tracking Technologies

  • We use cookies and similar technologies for functionality, analytics, and marketing.
  • You can manage or disable cookies through your browser or device settings; however, this may affect app functionality.

9. Security

  • We implement industry-standard security measures to protect your data.
  • However, no system is completely secure. We disclaim liability for breaches beyond our reasonable control.
  • In case of a data breach affecting your personal data, we will notify you promptly and no later than 72 hours after discovery.
  • Notifications will include breach details, risks, and mitigation steps.

10. Account Suspension and Termination

  • We may suspend or terminate your account for violations of these Terms or misuse of the app, with or without prior notice.
  • Suspension or termination may occur due to fraudulent behavior, abusive conduct, violation of law, or repeated breaches of these Terms.
  • Upon termination, your rights to use the app will cease immediately.

11. Indemnification

  • You agree to indemnify, defend, and hold harmless Lost and Found Crew, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, or expenses arising out of your use of the app, violation of these Terms, or infringement of any rights.

12. Limitation of Liability

  • The app and services are provided “as is” and “as available,” without warranties of any kind.
  • Lost and Found Crew is not liable for any indirect, incidental, consequential, or punitive damages, or any damages arising from loss of data, downtime, or unauthorized access.
  • Your use of the app is at your own risk.

13. Service Availability and Force Majeure

  • We strive to maintain reliable service but do not guarantee uninterrupted availability.
  • We are not liable for interruptions caused by factors beyond our control, including natural disasters, cyberattacks, or internet outages.

14. Changes to Terms

  • We may update these Terms occasionally.
  • Significant changes will be communicated via email or app notifications at least 15 days prior to taking effect.
  • Continued use of the app after changes constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of Gibraltar.
  • Any disputes arising out of or relating to these Terms or the use of the Lost and Found Crew app shall be resolved by binding arbitration where permitted, or otherwise by the courts located within Gibraltar.
